Preamble
These terms and conditions govern the contractual relationship between, on the one hand,

In accordance with the provisions of Articles 6-III and 19 of the French Law on Confidence in the Digital Economy, we hereby inform you that METROPLEX INVESTISSEMENT is a SASU (simplified joint stock company) with capital of 10,000 euros, located at 16 rue du pavé des roizes 77860 Quincy voisins FRANCE, registered with the Meaux Trade and Companies Register under number B 482 356 136, and whose SIRET number is 48235613600036 and whose Intracommunity VAT number is FR13482356136.
The publication director of AEROGRAPHYdiscount is the CEO of the SASU.
and,
any person wishing to make a purchase via AEROGRAPHYdiscount hereinafter referred to as "the Buyer", on the other hand.
1. Acceptance of conditions
By validating an order, both parties acknowledge that they have read these general terms and conditions of sale and declare that they accept them unreservedly.
These general terms and conditions of sale take precedence over any other condition appearing in any other document, unless expressly waived in advance in writing by AEROGRAPHYdiscount. They may be amended at any time by AEROGRAPHYdiscount and apply to all sales made after their publication on the site.
2. Products
The products and services offered are those shown in the catalogue published on this site, while stocks last.
Each product is accompanied by a description drawn up by the supplier.
AEROGRAPHYdiscount also declines all responsibility for the consequences of a malicious act caused by a third party and leading to a modification of the content of the site.
3. Awards
Product prices are quoted in Euros (€), inclusive of all taxes, and exclude shipping costs.
The prices mentioned on AEROGRAPHYdiscount are valid at the time they are consulted by the Buyer or during the period indicated. The prices invoiced are those in force at the time the order is placed.
Depending on the country to which the order is shipped, the Buyer may be considered to be the importer of the product(s). In this case, customs duties or other local taxes or import duties or state taxes may be payable. These rights are not the responsibility of AEROGRAPHYdiscount They are the responsibility of the Buyer. They are entirely the Buyer's responsibility, both in terms of declarations and payments to the competent authorities and bodies in the country of destination. The Buyer is therefore advised to obtain information on these aspects from the local authorities.
4. Control
The automatic recording systems are considered as proof of the nature, content, price, date and contact details of the recipient of the order.
The sale will only be concluded once the order has been confirmed and the payment has been validated by the bank concerned. AEROGRAPHYdiscount will confirm acceptance of the order to the Buyer at the e-mail address provided.
AEROGRAPHYdiscount reserves the right to cancel any order from a customer with whom there is a dispute relating to a previous order.
The information provided by the Buyer when placing an order is binding: in the event of an error in the recipient's details, AEROGRAPHYdiscount cannot be held responsible for the impossibility of delivering the product.
If a product is not available, AEROGRAPHYdiscount undertakes to inform the Buyer as soon as possible. If a product ordered and paid for is unavailable for more than 30 days, the order for this product will be cancelled and reimbursed on written request, with the remainder of the order remaining firm and definitive.
5. Payment
AEROGRAPHYdiscount offers the Buyer several means of payment:
-Secure BNP payment by credit card,
-PAYPAL: the Buyer's financial details are only communicated to PayPal, which protects them using renowned anti-fraud technologies. To find out more about PayPal: http://www.paypal.fr/fr
-Payment in instalments.
-Bank transfer: the number of the account to be credited is given to the Buyer when the order is validated.
-Cheque payable to METROPLEX INV: the order will be dispatched on receipt of the cheque sent to METROPLEX INV. 16 rue du pavé des roizes 77860 Quincy voisins FRANCE,
6. Delivery
AEROGRAPHYdiscount books all over the world from its warehouse in France.
The Buyer has several delivery methods to choose from during the ordering process.
Postage costs are calculated automatically according to the carrier, weight, size and destination of the parcel. They are payable by the Buyer and are specified when the order is validated.
AEROGRAPHYdiscount undertakes, once an order has been confirmed and payment validated, to send the products ordered from stock to the chosen carrier within 24 working hours. Orders placed on Friday, Saturday and Sunday will be dispatched on Monday.
Parcels are delivered to the address specified by the buyer.
The Buyer can track the progress of his/her parcel by logging on to the chosen carrier's website. If the Customer is absent at the time of delivery, a delivery notice specifying where and when the parcel can be collected will be left in the recipient's letterbox.
Any anomaly noted at the time of delivery (damage, missing product compared to the invoice, damaged package, broken products, etc.) must be reported immediately to the carrier by e-mail or by post to AEROGRAPHYdiscount to benefit from the insurance provided by the carrier.
Important for our Swiss customers: Please note that our warehouse is located in France. Therefore, for all deliveries in Switzerland with a value of over CHF 65, customs taxes may be applied and will have to be paid by the recipient upon receipt of the parcel. We advise you to take this information into account when placing your orders to avoid any surprises on delivery.
Important for our UK customers: All orders over £150 may be subject to import duty and VAT. These additional charges are calculated by the customs authorities when the parcel arrives in the UK and must be paid by the recipient before delivery can be completed.
7. Back
Not satisfied with an item? In accordance with current French regulations, the individual Buyer has a period of 14 working days from receipt of the parcel to exercise his or her right of "retraction".
Prior to any return, the Buyer must inform AEROGRAPHYdiscount of his intentions by e-mail, specifying the order number and his wish: exchange or refund.

Unless the item delivered is defective on receipt or does not correspond to the reference ordered, the return costs will be borne by the Buyer.
For the return to be accepted, the item must not have been used or modified in any way that would prevent it from being remarketed. It must be returned in its original packaging.
In the event of a compliant return AEROGRAPHYdiscount will exchange the item or reimburse the Buyer within 30 days, using the same means of payment as the one used to place the order. In the event of non-compliance, the item will be returned to the Buyer at his/her expense.
This right of withdrawal does not apply to companies.
8. Product warranty and after-sales service
Article L.217-4 of the French Consumer Code:
The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity at the time of delivery.
He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was& made his responsibility by the contract or was carried out under his responsibility.
Article L217-5
The goods conform to the contract:
1° Whether it is fit for the use ordinarily expected of similar goods and, if so :
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Articles L217-12
Any action arising from a lack of conformity must be brought within two years of delivery of the goods.
Article L217-16
When the buyer asks the seller, during the period of the commercial guarantee granted to him at the time of the purchase or repair of a movable good, for a repair covered by the guarantee, any period of immobilisation of at least seven days is added to the duration of the guarantee which remained to run.
This period runs from the date of the purchaser's request for service or from the date on which the goods in question are made available for repair, if the goods are made available after the request for service.
All items are guaranteed for 2 years or more (see item description) or 6 months for repaired and refurbished items, from the date shown on the invoice sent to the Customer, with the exception of consumables and textile items.
In the event that an item proves to be defective, has a hidden defect or has been rendered unfit for use before the date of receipt by the Customer, during the commercial guarantee period, the Customer must contact Customer Services on 01.61.10.45.99 (cost of a local call from a landline in France), who will tell him/her how to return the item.
The costs and risks associated with returning the item shall be borne by the Customer.
After examination of the article, Aérographe Discount reserves the possibility either of repairing it, or of refunding it at the purchase price. In this case, Aérographe Discount will issue a credit note usable on its sales site or will proceed with the reimbursement at the Customer's request.
The repair or refund will take place within 30 days of receipt of the defective item by Aérographe Discount. The repaired or exchanged item is sent to the Customer at the expense of aerographediscount.fr.
If the item is immobilised for more than 7 days, the initial commercial guarantee period will be extended by the immobilisation period in accordance with article L.221-18 of the French Consumer Code.
The Customer may not invoke the commercial guarantee if the defect results from :
- normal wear and tear of the item and/or its component parts and/or accessories,
- abnormal use and/or mishandling
- poor maintenance
- force majeure
- use, installation or connection that does not comply with the manufacturer's specifications
- commercial or collective use
- the use of unsuitable peripherals, accessories or consumables
- repairs carried out by a third party not approved by Aérographe Discount and/or the manufacturer
Independently of the commercial guarantee thus granted, Aérographe Discount remains bound by the defects of conformity of the product to the order and hidden defects under the conditions provided for in articles 1641 and 1649 of the Civil Code.
In accordance with the provisions of order no. 2005-136 of 17 February 2005, the aforementioned articles of the Civil Code and the articles of the Consumer Code relating to the guarantee of consumer goods are reproduced in these General Terms and Conditions of Sale.
Refurbished and repaired products are, by their very nature, items that have been used before. These products may show signs of wear linked to their use (micro-scratches, packaging different from the manufacturer's packaging, etc.). These characteristics inherent to the nature "refurbished and repaired" could not be taken in charge by Aérographe Discount within the framework of the guarantee since they do not call into question the basic functionalities of the products.
Guarantee against hidden defects:
Article 1641 of the French Civil Code
The seller is liable for any hidden defects in the item sold that render it unfit for its intended use, or that impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he or she been aware of them.
Article 1648
Any action arising from redhibitory defects must be brought by the purchaser within two years of discovery of the defect.
In the case provided for by Article 1642-1 In the case of an apparent defect or lack of conformity, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be relieved of the defect or lack of conformity.
9. Personal information
The Buyer's privacy is respected, AEROGRAPHYdiscount undertakes to ensure that the collection and processing of personal information on the site is carried out in accordance with the French Data Protection Act (Loi Informatique et Libertés) no. 78-17 of 6 January 1978 relating to data processing, data files and individual liberties. In this respect, AEROGRAPHYdiscount has been declared to the CNIL under number XXXXX.
In accordance with article 34 of the same law, AEROGRAPHYdiscount guarantees the Buyer a right of opposition, access and rectification of the personal data concerning him/her, via the Members' Area of the site and/or the contact e-mail address xxxxxx.
10. Limitation of liability
AEROGRAPHYdiscount It cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
11. Intellectual property rights
AEROGRAPHYdiscount is the property of METROPLEX INVESTISSEMENT in its entirety, together with all related rights. Any reproduction, in whole or in part, must systematically be subject to the authorisation of the owners. However, hypertext links to the site are authorised without specific request, but METROPLEX INVESTISSEMENT declines all responsibility in the event that the content of these sites contravenes the laws and regulations in force.
